Default My poor bike

My poor bike,I think it is dead!

I was minding my own business riding along a little way behind a big van.I saw roadworks blocking the road so I stopped,the van stopped about 10 or 15 feet ahead,then stuck it in reverse,I was beeping my horn and revving the engine,did he hear me?Did he hell!
He started rolling towards me,I made a pathetic effort to push bike backwards as fast as the van was moving,this didn't work too well.
I couldn't ditch the bike because there wasn't enough time to move out the way,so I had to sit and wait for it to hit!
Just my luck to get a fast driver heading at me,the van engine was screaming by the time he reached me.I knew he would carry on going a little way until he had time to react to the crash so i twisted to the side as I was thrown in the air.I landed about 10ft away on my back.
I am ok apart from general aches and feeling like I have been kicked in the nuts,but my poor bike is dead!
I loved that bike........

Sorry about your loss. At least you are uninjured.

These things can sometimes be averted by stopping behind and to the driver's side of vehicles, so they can see you. Not always, and not saying you did anything wrong. Just throwing an idea out there for the rest of us reading this on how to avoid a similar fate.

Not to be hyper-litigious, but you have compensation coming. Seek the advice of an attourney.

My brother had a similar experience when he was in junior high. 10 years later he's still suffering. Don't close any doors just yet.

BTW, you now know why we recommend keeping the bike in gear, and as 98G said, stay to the side. You might have squirted out of the way had you been prepared for such an idiotic move.

I usually plan for the stupidest thing a cage driver can do at a point in time and be ready for them to do it.

You might only feel a few aches, but you should defintely see a doctor, possibly an orthopedist, ASAP. Soft tissue damage can be very serious, even if it's not obvious like a fracture. And if you were thrown by the impact, it's more likely to be serious.

Also, seeing a doctor right away will help you later on if you need to see a lawyer. (One of the first questions a good lawyer will ask you is "Have you seen a doctor?" Also a good PI lawyer should be able to reccommend an orthopedic doctor.)

Thanks for all the sympathy.
Got my courtesy bike yesterday until my claim is sorted out.Got a Kwak ER-5,not exactly what I am used to but at least I don't have to go begging for lifts off other people.
All sore parts are better now and I have stopped walking about like Ozzy Osbourne!
Doc checked me out and apart from aches and pains no harm was done.

It didn't take long after impact for him to stop,but it seemed like a while before he got out,I was quite happy just lying on the ground anyway!
The driver couldn't apologise enough and tried explain why he didn't see me.I did point out that I had been behind him for 300 yards and spent most of the time in plain view of his mirrors and the only reason he didn't see me when he started reversing is because he had turned the van a bit and moved the view he got in his mirrors.
He was sorry and even offered to put the bike in the back of his van,but I told him that me and my bike had had enough of vans for one day!

Just a quick update on the saga of my bike.

I got a call from my insurance company saying to expect a call from the bike hire company to organise taking the courtesy bike off me!
I asked why and my advisor told me to take it up with the other parties legal advisor.So I phoned my solicitor to ask what was going on,she said because I didn't get witnesses details the other side were trying to say the van was stationary and I rode into it!
I pointed out that all the damage to my leathers was at the back were I landed after my short flight and the damage to the bike was right for something that had been hit then pushed along on its side,and I also pointed out that the driver had written me a note admitting liability at the time of the accident...
....this changes everything!
My solicitor asked for this note,I told her she would get a copy in the next post.She said that was enough to secure my claim and she would be in touch with other parties insurance TELLING them I am keeping the courtesy bike until my bike is repaired or replaced,so fingers crossed it will all be ok.

Listen to Marcos, You have had pain and suffering. Don't let the insurance folks scare you away or minimally compensate you.

If you had any medical treatment at all/pain, You should be compensated.

Glad to hear you survived.

Really sorry about the bike Man, some days life shows up and it aint too pretty. Enough to really piss u off about people and Lawyers though. I'm sorry to hear the lawyer part. I learned the hard way: always call the police make an accident report right there. Best Wishes
